Dear Mr. McGinley:

Your latest e-mail, dated September 12, 2000, to the Governor's Office

regarding the investigation into the death of your son, was forwarded to the

Office of Executive Investigations for response.

As you are aware, it is the position of the Florida Department of Law

Enforcement that the investigation of the death of your son, while tragic,

does not establish a criminal predicate that would warrant further

investigation by the FDLE. This investigation has been fully reviewed, not

only by this agency, but also by the Tampa Police Department, the Florida

Highway Patrol and the State's Attorney for the Thirteenth Judicial Circuit

with all agencies coming to the same conclusion.

While we understand your strong feelings regarding the loss of your son,

further review or investigation is not warranted. We respectfully disagree

with your accusations that FDLE or the other law enforcement agencies

involved have conspired to prematurely or improperly dispose of the

investigation regarding your son's death. You are certainly free to pursue

other avenues of redress in the civil courts or otherwise.
