NEW EVIDENCE REGARDING THE DEATH OF KEVIN McGINLEY.

 

Dear Governor Bush,

As you are aware, I have repeatedly written to you presenting evidence showing that our Son, Kevin McGinley, was the victim of a brutal murder. Furthermore, I have provided evidence clearly indicating that both Florida Highway Patrol and FDLE have acted in an improper manner in failing to investigate the evidence in their possession and also by falsely presenting the evidence in an effort to portray our Son's death as a traffic accident.

Last year you requested FDLE Commissioner Moore to conduct a review of this matter following our complaints that Regional Director Sewell had refused to investigate our complaints against Agent Dey and Corporal Jetton of FHP. The actions of FDLE Executive Investigations Department, in referring this to Regional Director Sewell, clearly falls short of the intent of your request, which was to review the evidence we had submitted and also the merits of our complaints against Director Sewell and his department.

Following my letter to you dated September 12th 2000, I received an e-mail response from Inspector Merresse. This response once again reflects the continued refusal of FDLE and FHP to respond to the specific and well documented evidence provided to both them and your office.

As a result of the continued refusal of these agencies to perform their sworn duties to uphold the laws of the State, we were forced to continue our own investigations into the evidence we have provided to all authorities concerned. These investigations have revealed clear and substantiated evidence of the most disturbing nature. This evidence not only substantiates the fact that our Son was murdered but clearly indicates that Florida Highway Patrol were aware of this fact and in possession of this evidence at the onset of their investigation. Such actions represent a willful and reckless disregard of the truth and clear violations of our civil rights as well as other possible criminal violations. Furthermore, there are strong indications that FDLE and Tampa Police have actively encouraged these violations to varying degrees.

Given the nature of the evidence in our possession, the further involvement of any of the agencies previously involved in this case is clearly compromised. We have presented this evidence to independent organizations who firmly concur with the opinion of our investigators that there is an urgent need for a full and independent investigation into all aspects of this case.

I would request you, Governor Bush, to give due consideration to the evidence previously provided to you over the last eighteen months and grant us the opportunity to present this new evidence to you personally and in the company of our legal representatives and representatives of the organizations endorsing our request.
